Policy of Use and Infringements

Those of us who have used social networks for years deserved a reset, a start from scratch with an ethical, sustainable, transparent platform, worthy of our times and of what the future deserves. We measure sustainability in how our future is assured through your satisfaction, respect for you and your data, and the return to the society that we give.

Launchyoo is a platform in which we all have a place, but as in all cases of coexistence of a large number of people, with diverse sensitivities, interests, tastes, ways of seeing life and the world, it is necessary to establish a series of criteria to ensure good coexistence between us. To some, these rules will seem too lax, to others, too rigid. It is normal, everyone has their own vision and it is impossible to please everyone, but we can tell you that we have built them and apply them with maximum transparency and the absolute desire that they truly serve a purpose: that we are all at ease in this social network.

We place here the first two articles of the Universal Declaration of Human Rights, whose enlightening simplicity and strength we could never match. Did you ever think that you would find them in the explanations about the community rules of a social network?

Article 1.

All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.

Article 2.

Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

Based on this and as our guide, we ask you, please, to:

  • Be respectful of others. Behave with other users as you would like them to behave with you.
  • Do not attack the integrity and honour of people based on their race, sex, religion or condition. We all have the right to be who we are, if we do not seek harm to others.
  • Share content that is yours, or that is not but you are authorized to do so. Copyright disputes are growing alarmingly and may have bigger legal consequences than you think. Post content created by you. You can, definitely, Re-Post any content, since it has already been entered on the platform by the person who has the rights to do so.
  • Even if you have the rights to publish the content, if other people appear, you must have their authorization so as not to interfere with personal privacy and image.
  • Do not post inappropriate content. We apply a human control over the contents and that makes us different from the rest of social networks. We like art and artists who use their bodies to explore it, but there are limits. We do not allow the display of genitalia or images or videos of explicit sexual content, or that are purely crude, without artistic, informative or awareness-raising reasons. We do not accept extremely violent content or real unmotivated violence. Nor do we want Launchyoo to see proliferation of videos that show self-harm, bullying, violent transgressions, etc. It is much, much more what we allow than what we do not, but it is necessary and we hope you understand it, that some rules must be respected, for the good of all.
  • If any person publishes texts and/or content in which he or she talks about suicidal ideas or tendencies, we ask that you first contact that person to provide assistance. The second step is that you get in touch with someone close to him or her, or with the relevant authorities. And if nothing works, get in touch with us and we will try to do everything possible and in our power: customercare@launchyoo.com
  • Similarly, if someone publishes texts and/or content in which they display the real intention to commit a crime or any other type of illicit act, we invite you to immediately notify the competent authorities and, if this is not possible, to contact us, and we will do our best to resolve the situation: customercare@launchyoo.com
  • Do not break the law within the platform (or outside for that matter…). There are many ways in which this is possible, because human imagination is infinite: usurping the identity of other users, trying to access other users’ device, trying to sell material that you do not own or have any rights to, inciting illegal behaviour, selling illegal material, and so on. We will communicate to the relevant authorities any illegal activity of which we are made aware of in the platform.

Launchyoo does not allow, at the moment, to change the email address associated with the account you have created. This greatly limits the possibilities of profile hacking.

But if the email change becomes necessary, you can send us a request to customercare@launchyoo.com with the information of the new email. Our team will proceed to validate your identity and, once made, the change will be implemented and you will be notified.

In this way, we will never actively contact you, on the platform, proposing the change of email address and requesting new data. Anyone who acts in this way should quickly be the subject of suspicion on your side and the matter notified for us to operate accordingly.

If you have been a victim of hacking or you think someone you know has been, please contact us immediately at the email address above. We will be active to resolve the situation as soon as possible.

Ownership over the rights of exploitation and use by the creator or creators of content is a fundamental right, protected by law. At Launchyoo we take it very seriously and will act against any action that violates it. Intellectual property rights include copyright and trademark rights.

To publish or insert content on Launchyoo, you must hold the legitimate ownership of all the exploitation rights which allow their reproduction, distribution, public communication – even in the modalities of rendering it available – and transformation, by any electronic and digital means.

In addition, even if you are the legitimate owner of the exploitation rights over the content that you publish or share on Launchyoo, you must obtain the corresponding authorizations or permissions from the individuals that appear in such publications, in relation to their image rights, so as not to generate illegitimate interference in honour, in personal and family privacy and in the image itself, and to avoid violation of their rights in terms of data protection.

 

Everything said above is valid and effective for any social network and, in general, for any data exchange platform.

You can warn us of an infringement of any of these terms by letting us know the publication that has committed it (Flag of a publication), by writing us a message through the Help and Support option in the application menu, or by writing an email to customercare@launchyoo.com

If you find content on Launchyoo that you believe violates your personal rights or the laws in force in your geographic area, region or country, it is highly likely that it violates Our Community Rules. For example, apology for violence or terrorism, bullying, harassment, explicit sexual content, violation of privacy and individual rights, are things that cannot be consented within the new social network.

We provide you with the option to Flag a publication (click HERE to learn more) so that you can send us information about any inappropriate content. The icon from which you access it, […] three horizontal dots, is available at the bottom right corner of each post.

If the motivation for your complaint is the violation of your own rights, we ask you to clearly indicate this in the space dedicated to additional comments. Our content management staff will verify it as soon as possible.

Keep in mind that we use fair and equitable criteria, our philosophy is open and we promote respect between users, between people. That being said, the fact that you indicate us a post with content that you think is inappropriate does not guarantee that we will remove it.

Obviously, in case you are requesting to eliminate your own data (though you can find the tools to eliminate any post or information present in your profile page yourself), we will proceed on the double.

First of all, if you are reading this information out of necessity, please receive our sincere condolences. You can notify us of the death of a person with a Launchyoo account via customercare@launchyoo.com.

Our policy in these cases is to close the deceased person’s account. It is an intimate event and we want everything to remain in the hands and in the memory of those close to the missing person.

By virtue of article 3. Data of the deceased persons, of the LOPDGDD, if a relative identified as such requests it, we will apply to him or her the right of PORTABILITY of data that corresponds to each user, in this case, to the deceased user, on his or her own data. It will be possible for this relative to obtain the data of the deceased person in a structured format, and safeguard it. Data will then be removed from the platform.

 

As an exception, the people referred to in the previous paragraph may not access the data of the deceased, or request its rectification or deletion, when the deceased person has expressly prohibited it or so is established by the law.

In the event of the death of minors, these powers may also be exercised by their legal representatives.

Launchyoo is a platform for people who want to share, communicate and enjoy social networks in a different, more serene way. There is space for everyone here, as long as consideration is shown towards the rest of the users and the rules of coexistence set in place, based on mutual respect and freedom of expression.

We will never take part in disputes, we will never bias the information and we will never show our personal opinion in any aspect under discussion, but we will take the necessary actions to protect the community and all the people who coexist in it. First of all, illicit actions cannot be allowed, and will be reported to the competent authorities as soon as they are known to occur. In addition, inappropriate content, which may damage the general sensitivity, will be removed and the user who published it will be informed. You can consult the section “Flag a publication as inappropriate” to learn more about how to indicate that a post is indeed inappropriate. We therefore reserve the right to remove content, an advertisement or, ultimately, to block a profile, if it is repetitive in actions that may harm the community. When doing so, we will communicate beforehand. Before taking actions we talk, explain, discuss, not like the bots on other social networks. We are humans and for humans.

There are many specific cases that cannot have space in Launchyoo. We will treat each case separately, with objective and reasonable criteria. We only ask that, together, we try to make this social network a place of interaction from a positive attitude. Launchyoo was born to improve the present and future of social networks, and we hope that this is also reflected in how we all make use of it.

If another user has shared information in a post, through the content of the text or attached photos, video or audio, that violates your privacy, that of a relative of yours (particular emphasis always placed on minors), or that of a person who due to disability, illness, being hospitalized or limited, cannot defend him or herself, or if in general you observe a publication that supposes a flagrant violation of the intimacy and privacy of another person, we strongly suggest that you contact us.

Special case refers to that of minors. If a parent or legal guardian asks us to remove any content featuring their child, under the age of 13, we will do so without delay. If the minor is between 13 and 17 years old, the minor him or herself will have to send us the request to delete the content, unless he or she presents a physical or mental disability. We therefore encourage you to discuss it with them.

We point out, in any case, that for reasons of potential visible content on the platform, the Launchyoo registration process requires confirmation of being 16 years old or more.

To contact us you do not need to fill in any report or to go to other links. You can inform us from within the platform itself. Simply, access the function Flag a post present in all posts, accessible with the icon […] (three horizontal dots) at the bottom right corner.

You will access the menu where you can select one of the available options and write a comment, as long as necessary, indicating what the problem is. The more specific you are, the easier you will make it for us to make a decision about it.

In addition, you can contact us from outside the platform, through the email customercare@launchyoo.com. From there, we are at your disposal for whatever you need.

We are here to listen to you. Any situation in which we can apply ourselves to solve it, improve the platform, protect our community or allow you to better understand and enjoy Launchyoo, we will be happy to get to work.

If the problem refers to the content of a post shared by another user, which you consider inappropriate, you have the option to ‘Flag’ the publication. You can learn more at Report an Abuse.

If it is a technical problem that you have identified or a question, or if you want to unsubscribe from Launchyoo (🙁), you can write us from within the application. In the main menu you will find Help and Support, where you can give all the details about your request or complaint. Here you can also ask for generic assistance, leave us a suggestion, an assessment, a comment or report an abuse (user with inappropriate behaviour).

When we answer you, you will receive an email to your registration email from our customer service team, via email customercare@launchyoo.com.

One other thing: we suggest you to participate in the public group &LaunchyooFuncionalidades, where many of the options, functionalities and news about the application are explained. And for any case in general, you can write to us at customercare@launchyoo.com. The same people who receive the information by the other methods are also available to reply from this email address.

The new social network does not use algorithms that preliminarily eliminate content, without the action of people. It is you, the users, who tells us, with your own criteria, if the post shared by another user is inappropriate for any reason. From Launchyoo we will analyse each notification and act from a criterion of freedom and sensitivity. We will not apply censorship but some shared rules and thresholds need to be respected, and we reserve the right to remove posts from the Walls or from Groups that we consider inappropriate. We will proceed to contact users who repeat posting inappropriate content, in order to allow their alignment with respect to the limits of what can be shared. Informing, always.

The option to indicate a publication as inappropriate is available as “Flag a publication“, after clicking on the icon […] at the bottom right corner of each post. It is possible to indicate:

  • Copyright violation. If you know that the person who has shared content on the social network does not have the rights to disseminate it, let us know through this indication.
  • Violent content. Violent cinematographic content (filmed scenes) is allowed, but we will put a limit on the level of actual violence suffered by real people. This social network is not the right scenario for sharing extreme violence.
  • False News. We take False News or “Fake News” very seriously. With this indication you make us notice that someone has published a news that is not in accordance with reality, in a premeditated way. The parodies, jokes, gags or fictional stories based on reality cannot be considered Fake News.
  • Bullying. Psychological or physical bothering, by individuals or groups, to people who, due to their lower number or other particularities, may be considered weak, regardless of age, race, religion or sex, are considered Bullying. We are particularly sensitive to this type of violence and will be careful that its dissemination does not become an object of mockery. Obviously, the cases of chronicle or news that, as unpleasant as they might be, are part of the events, and whose dissemination avoids making an apology for the act, will be accepted.
  • Explicit sexual content. We do not apply indiscriminate censorship, we appreciate art, aesthetics and the human body to an immensely greater extent than the rest of social networks. This said, it is necessary to establish limits when there are many of us who share the same space. At Launchyoo we do not accept images, videos or audio files that contain explicit sex, nor the display of the genital organs before the camera. But we are delighted to welcome artists who play with the lights and shadows, the colours, of any landscape as well as their own body, so that they can find here the space in which to share their art.
  • Generic flag. This option can be used when you consider that a publication is not suitable and should be removed from the Walls, while the reason does not coincide with any of the typologies described above. Please accompany it with an explanatory text so that we can act with knowledge of the facts.

In any of the abovementioned cases, you can write a text describing us, with all the detail you consider necessary, the reasons why you think the post should be deleted. You will help us to act. Obviously, your indication is absolutely anonymous.
